A dilapidation survey report is an independent document that records the current condition of a structure at a given point in time. It records any existing tilting, subsidence, cracking, deviation, heaving or water ingress to a structure. This could also include public assets. 1. Why should I conduct a dilapidation report?

Dilapidation reports mitigate any risk or claims from neighbouring property owners, local councils and other bodies such as Sydney Water.

It is a known fact based off court cross examination that an occupant of a neighbouring property will commence looking at interior walls and ceilings like never before once they hear excavators or feel vibration from an adjoining building site. They then often view pre-existing cracks for the first time and blame this on the particular aspects related to build/development of adjoining property.

You can greatly minimise the risk of a potential claim by identifying the condition of adjoining properties and sharing the findings with the owners prior to commencement of demolition, excavation and/or construction work.

Dilapidation reports are also useful for the owner of a property adjoining a development site or roadworks. A pre purchase building inspection can be the difference between identifying a minor issue in or around the related construction project, for example. A simple problem like cracks in the footpaths of the surrounding properties may affect construction works.

It is recommended that you obtain a dilapidation report conducted prior as a property owner alongside any construction site even if the builder is conducting their own upon your property.  

In these circumstances, Dilapidation Reports can be an excellent base line to compare the condition prior to and after the building works and could be utilized in litigation if the building works or negligence results in damages to your property.

2. What should a dilapidation survey report include?

A dilapidation report is a professional service, giving a report on the condition of a structure at a given point in time. It records any existing tilting, subsidence, cracking, deviation, heaving or water ingress to a structure. This could also include public assets. 

Note there is no Australian Standard for the format of dilapidation reports or property condition reports. Therefore, it is fundamental that the inspector conducting the inspection has extensive court experience in relation to what is and what is not required within a dilapidation report. Many inspectors’ reports will not be accepted as evidence.

Following are some of what is required within the format of a detailed report.

  1. The dilapidation inspections of any cracks within a structure must be described beneath and/or above any photo of cracks taken. Example of this would be the direction with which a crack travel’s (horizontal, vertical, stepped) and/or (south/north/west/east), it’s exact location and approximate length and width.

  2. Crack width should be measured with a digital calliper. The exact location of where crack width was measured must be described so the width of crack can be precisely measured at a later date if required.

  3. An approximate measurement in mm of any heaving, tilting or subsidence to a structure must be described beneath and/or above any photos.

  4. All photos must be time and date stamped.

  5. The inspector is not describing how the current crack, tilting, subsidence or heaving occurred within a structure. Or what will occur in the future. The inspector is simply identifying the current condition at the date and time of inspection.

3. What type of structure requires a dilapidation report?

Any structure that could be structurally affected by surrounding properties, adjacent development, council assets, road works, tunnelling, excavation. A pre-existing condition may arise when undergoing a thorough inspection.

4. What is a suitably qualified inspector?

It is our opinion based on our court experience with such cases that a suitably qualified inspector at a minimum is a licensed builder with vast experience as a building expert witness within the small claim’s tribunal, district and supreme court within the state they are operating.

A structural engineer is only required to conduct the dilapidation survey if particular services or aspects are specified/requested within a condition of the development approval. 

Note many of our competitors are either inadequately qualified or do not format their reports correctly. Therefore, their reports will not be accepted as evidence in a small claims tribunal or court system.

You must also request copies of the inspector’s complete professional indemnity insurance. Many companies do not have suitable insurance.
